ANHRI calls UAE authorities to release of the human rights advocate and the prominent lawyer “Mohammad El-Roken” and the prisoners of conscience

 

The Arabic Network for Human Rights Information, declared  its full solidarity with the lawyer, “Mohammed El-Roken”, who will appear before the prosecution tomorrow to review the decision to renew his custody.

He will appear tomorrow before the State Security Prosecution to review the order to renew custody case in the case no. 79/2012 state security, which issued, on August 7, a decision to renew the custody for a month, ends tomorrow, in light of absence of a time limit for preventive custody in the law of Criminal procedures UAE, which will result in the absence of the legal obligation to bring the defendant to trial within a certain period of time.

The Emirati security forces arrested him on July 17, 2012, and there are no available information about his place of arrest, according to a statement the Federal Attorney General, the detainee – as well as 45 other detainees of the total of 57 detainees – face a sentence up to  15 years in prison, according to the charges prescribed in the Article no. 180 of the Federal Penal Law, which states (punishment of temporary imprisonment for each of who establishes or founds or organizes or manages an association or organized body or a branch of any of them aims to overthrow the government in the State or to promote to it whenever the use of force were remarkable), as well as (punishing who joined an association or body or organization or a branch of one of them or involving in them, knowing its purposes by imprisonment for not more than five years).

ANHRI said that: “The rejection of the State Security Prosecution for all the requests made by the lawyers of “El-Roken “to meet him, to attend the interrogation, review the investigation papers or take a photo-copy of it, as well as the non-disclosure of the place of arrest, are a clear violation of his fundamental rights as well as violation of all laws and international treaties and conventions binding the UAE. ”

ANHRI added that “the UAE authorities must determine the time period for the preventive custody, of making the defendant appears before the competent courts to complete the case process, as applicable in countries that respect the rule of law.”

ANHRI called the prosecution to immediately release him and all those who are arrested for the case known (Plotters against Homeland), for nothing but joining the call of reform calling for making political and social reforms in the country also calls for the drop of all charges against them, and to do not prosecute them.
